BY USING THE PAYFAST WEBSITE (THE “SITE”) AND THE PAYMENTS PROCESSING SERVICE OFFERED BY IT (THE “SERVICE”), YOU (THE “USER”) ARE INDICATING YOUR ACCEPTANCE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS END USER AGREEMENT.
1 GENERAL
1.1 This end user agreement may be changed without notice. Your continued use of this Site after any such changes constitutes your acceptance of the new end user agreement and its terms and conditions.
1.2 The headings of the clauses in the conditions is provided for convenience and ease of reference only and will not be used to interpret, modify or amplify the terms of the conditions.
1.3 No failure or delay by PayFast to exercise any of its rights will be construed as a waiver of any such right, whether this is done expressly or implied, nor will it affect the validity of any part of this end user agreement or prejudice our right to take subsequent action against the User.
1.4 PayFast cannot screen or edit all the content available from the PayFast site and does not accept any liability for illegal, defamatory or obscene content. Users are encouraged to inform PayFast of any content that may be offensive or illegal.
2. PAYMENT OPTIONS ACCEPTED
Payment may be made via Visa and MasterCard.
3. CARD ACQUIRING AND SECURITY
Card transactions will be acquired for Moringa 5000 via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
4. CUSTOMER DETAILS SEPARATE FROM CARD DETAILS
Customer details will be stored by Moringa 5000 separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za.
5. MERCHANT OUTLET COUNTRY AND TRANSACTION CURRENCY
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).
6. RESPONSIBILITY
Moringa 5000 takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.
7. COUNTRY OF DOMICILE
This website is governed by the laws of South Africa and Moringa 5000 chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
